West Virginia Police Misconduct Lawyer
Protecting You From Excessive Force and Other Police Misconduct
Most police officers are good, hardworking men and women who give careful consideration to the rights of the people they contact. These officers deserve our constant thanks for the protection they provide on our highways, in our counties, and in our cities and towns. There are, however, a small minority of officers who either purposely or carelessly step over the constitutional boundaries that govern their conduct.
I am attorney Rob Frank in Lewisburg, West Virginia. I believe in good law enforcement. However, law enforcement officers who step over the line can and do cause real and lasting harm, both to the citizens they contact and to the good officers whose reputations they tarnish.
Holding Police Accountable
I have successfully litigated cases of excessive force and other police misconduct in West Virginia, Colorado, California and other jurisdictions. In 2009, a fee expert filed a declaration in a Colorado court stating: “My opinion is that Mr. Frank is the most competent lawyer currently handling excessive force matters in Colorado Springs.”
I am very selective in the cases I take, normally accepting fewer than one in every 10 cases that are referred to me. Before I take on a case, there must be:
- An action by a police officer which is unreasonable
- Evidence of wrongdoing beyond the statement of the plaintiff
- Serious and/or life-altering injury or death
If I take your case, it means that I believe it to be a serious case involving a serious constitutional violation and serious injury.
Cases of excessive force and unreasonable search and seizure by police officers are filed under 42 U.S.C. § 1983 and are commonly known as “section 1983” cases. These cases are time-consuming and difficult to pursue, but are absolutely necessary to protect the sanctity of our constitution, to protect the rights of our citizens, and to protect the reputations of the overwhelming majority of good officers.
